  • Decision as to whether a provider was obliged to offer 2015 fees to student who withdrew from the course and opted to defer his studies until 2016, or to provide a full refund of fees paid.

    A student enrolled in a full year course, paying the full years fee prior to the course commencement. The student completed the first semester, albeit commencing late and obtaining poor results which meant that they needed to repeat the first semester which increased the study length from 1 year to 18 months. Prior to commencing the second semester, the student elected to withdraw from the programme stating that the 2016 course fee had increased unfairly and they could not afford to pay it.
  • Decision concerning compensation sought by student after provider wrongly disposed of the student’s personal property

    A student stored personal property in lockers that were allocated to him by his education provider during the 2016 Academic Year. When the student returned to commence the 2017 Academic Year, he discovered that his personal items had been removed from his locker. The student sought compensation to the value of the property lost, as well as a formal apology from the education provider.
  • Decision concerning amount of refund due following student withdrawing from course 5 days after course commencement – complaint dismissed

    A Student withdrew from their course five days after it commenced and received a 75% refund of the course fees that were paid. The Student did not believe this refund to be a fair or satisfactory and made a complaint to iStudent Complaints.
  • Decision concerning refund following students (Husband and Wife) withdrawal shortly after commencement of course – complaint dismissed

    A husband and wife (the Students) enrolled in a course which they attended for a few weeks, prior to withdrawing from the course. The Students paid their course fees in advance and sought a refund for the balance of the course fees. The Education Provider agreed to refund a portion of the fees only.
  • Decision concerning amount of refund due following NZQA finding – complaint upheld

    A Student lodged a complaint with NZQA about the staffing and quality of the course she was enrolled in, and applied for a partial refund of her course fees. Following negotiations, the Provider deposited $23,000 to the Student and requested an acknowledgment that the amount was to be considered a full and final settlement of the complaint. There was no signed agreement between the parties and the Student did not consider the amount to be a full and final settlement.
  • Decision concerning refund following student withdrawal after commencement of course - complaint not upheld

    This decision relates to a complaint from the Students, against Education Provider (the provider). The Students enrolled in a full-year (three trimester) course with the Provider, paying the full year’s fee prior to the course commencement. The Students completed the first trimester. Prior to commencing the second trimester, the Students elected to withdraw from the programme, and pursue an alternate programme at a different tertiary provider.
